NMC Defence Barristers have successfully argued against a complaint of a fraudulent entry to the NMC register for a nurse.

The case  

Nurse ST received a police caution for theft.  The caution was described to ST as a “slap on the wrist”.  When ST submitted her NMC revalidation forms, she answered no to a question asking for disclosure of any police cautions, charges and convictions.  Her registration with the NMC was consequently renewed for a further three years.

However, on seeking employment with a new agency, the seriousness of the caution was make known to ST who then self-referred to the NMC.

NMC Investigating Committee

ST has from the outset of the hearing admitted that her entry on the register was incorrectly made.

The NMC sought to persuade the committee that ST’s entry was with the deliberate intention to mislead.

However, representing ST was joint head of Kings View Chambers and NMC Defence Barristers Catherine Stock, who agued successfully that the omission was not with intention to mislead citing, amongst other things, that ST would not have self-referred otherwise.

The committee resolved that the entry on the register was not fraudulently procured.  The matter was remitted back to the Registrar with direction to remove the entry on the register.
