Kings View Chambers have helped a nurse successfully appeal against summary dismissal for breach of data protection. 

JM instructed health and care defence barrister Catherine Stock to provide legal advice on her case, draft grounds for appeal and assisted in preparing for the appeal hearing. 

With Catherine’s assistance, JM’s appeal was dismissed and JM’s registration was reinstated. 

Catherine said: “This case highlights the tougher line that Trusts are now taking in respect of any breach of GDPR.  It is worth checking your Trust policy to ensure you understand what can be considered a breach. 

“As with most cases we advise that you should appeal the decision even if your grounds of appeal are weak. If you do not appeal and the matter is then considered by a regulatory tribunal, failure to appeal an internal decision can often be construed as acceptance. 

“It is better to obtain specialist legal advice as soon as possible at fact finding stage.”
