A NMC fitness to practise panel has thrown out all the NMC’s allegations of dishonest conduct made against our client.

Our client, GR, was accused by the Nursing & Midwifery Council (NMC) of dishonest conduct in relation to a case where a patient sustained injuries.  GR maintained that another colleague was responsible for the injury but, the NMC accused them of dishonest conduct, alleging that GR sought to conceal their involvement in the incident.

When GR was notified of the NMC referral, they initially sought support and advice from their trade union. GR however commented that:

“Unfortunately, the RCN let me down as an RCN member in a time of need. When I went to them for help at the beginning of my NMC case, I was misled and misrepresented by non-legal RCN employers, resulting in my case going through to the highest process of fitness to practice panel hearing.”

Following this, GR instructed Kings View Chambers and was represented by joint head of chambers and fitness to practise defence barrister, Catherine Stock.

Catherine successfully persuaded the fitness to practise panel that there was no case to answer in the vast majority of the allegations.  The NMC resisted Catherine’s case in its entirety however, the panel determined that, taking account of all the evidence before it, there was no realistic prospect that it would find the facts of the charges proved and therefore there was no case to answer in respect of the charges.

With Catherine’s representation, the panel found no misconduct in GR’s case and consequently that GR’s fitness to practise was not impaired by reason of misconduct.
