A nurse who was removed from the NMC’s register has successfully applied for re-registration with the assistance of Kings View Chambers.

This case involved immigration matters, which, had long since, been resolved in the nurse’s favour. The substantive case related to the nurse, EH, using a fake passport to obtain her nursing qualification in the first place and the same fake passport to register with the Nursing and Midwifery Council (NMC).

Nurses are taken off the NMC’s register if they were on it incorrectly [minor issue] or fraudulently [major issue] in the first place.  In these circumstances, the nurse is not stuck off or erased, but “removed”.  EH, was removed from NMC register for using the fake passport to register in the first place.

Following her removal, EH initially applied for re-registration herself but, the application was refused by the NMC.  Following this, EH approached Kings View to assist her with her re-registration.  With the support and advice from Kings View, a further application was successful.

Speaking after the conclusion of the case, fitness to practise defence barrister, Catherine Stock, said:

“In these type of cases, the nurse simply applies to go back on the register.  There is no hearing, and the NMC can either grant the application to register or refuse.  Whilst there is a right of appeal, this is to the County Court, but the County Court very rarely see these types of applications and consequently do not know how to deal with them. 

 

“In this case, EH had worked extremely hard on obtaining her initial qualification as a nurse and subsequently on preparing for re-registration with a strong focus on insight and remediation. 

 

“We can assist nurses facing having difficulty in re-registration following a finding of incorrect or fraudulent entries.”
